EMERGENCY MEETING IS BEING HELD AT THE ACCESS LOT ON FRIDAY, MARCH 27,2015 AT 6:30 P.M (RAIN, SHINE OR SNOW) REGARDING ACCESS LOT SINK HOLES/RETAINING WALL!
The General Annual Meeting will be on Saturday, May 16, 2015 at 11:30 a.m. in the Access Lot rain or shine.
The Annual Meeting on May 17th was productive. The changes to the By-Laws that were listed on the last newsletter were approved and were filed with the County of Mecklenburg. Discussions were held regarding the sink holes present in the Access Lot and the new Access Lot Committee is busy getting bids to determine how to proceed. The poll taken at the meeting showed that the majority of those homeowners present preferred that the retaining wall be repaired/refurbished. New keys were issued, and your parking pass will remain the same.
This year has flown by, so please neighbors start thinking about becoming more active in your neighborhood by running for a position on the Board (President, Vice-President, Secretary, Treasurer) or Member at Large. A committee will need to be created in March 2015 to discuss and suggest homeowners for Board positions. Board members serve for a period of 2 years. Please, please help your neighborhood continue to thrive.
The Nominating Committee is responsible for obtaining nominees for the Executive Board, the Member At Large, and the Judicial Committee members. The Board has made a concerted effort to find volunteers willing to be appointed to the Nominating Committee to no avail. Anyone who may be interested in heading up the Nominating Committee, please contact Janice T. at 704-987-9783 prior to 03/25/15. Nominees for Executive Board positions and Judicial Committee members should be sent to Ann Pappas (Secretary) by 05/01/2015. In the event there are volunteers for the Nominating Committee or volunteers for nominees for the Executive Board, Member At Large or Judicial Committee members, nominees will be taken from the floor at the General Annual Meeting on Saturday, May 16, 2015 at 11:30. Should no volunteers be found, a management company might need to be considered.
The use of the parking passes seems to have controlled a lot of the unauthorized activity at the Access Lot. Memorial Day was quiet and orderly according to those nearest to the lot. No police were needed or called, according to the Board.
Some neighbors have complained that trash is being dumped on lawns very early in the morning. If you happen to notice someone doing so, please contact the Cornelius Police Department and file a report. Also please remember that dogs off leash running freely in the neighbhorhood is against Cornelius City laws. Neighbors really don't enjoy doing doggie doo duty for someone else's dog.
Committee Projects Updates:
Judicial: They have reviewed any official complaints.
Beautification: Thank you goes to Teresa Carson for taking care of the entries, changing flowers and dealing with lighting issues. Per Teresa, the front entrance lights will be replaced as soon as the weather permits this year. Attempts were made to repair the existing lighting, but it just finally gave up--Sorry for the long, dark winter! Improvements with the landscape will follow shortly thereafter. Thanks & Happy Spring!
Social: May 2014 Meet & Greet was attended by approximately 50 neighbors, enjoying a live band and a simple barbecue. No other events were planned for the year.
Access Lot: Bids have been received, evaluated by the Committee, and the funds approved by the Board. Emergency meeting is to be held on
March 27th at 6:30 p.m. to vote for approval of funds to begin repairs while the water is at its lowest.
No semiannual General Meeting was called as no homeowner expressed an interest or an urge for a meeting.
The General Annual Meeting will be on Saturday, May 16, 2015 at 11:30 in the Access Lot rain or shine. The meeting will include discussion of the following revisions to the Bylaws. After careful review by our current President, some inconsistencies were noted (see below). The Board is suggesting revision of these items for clarity, and these will be voted on at the General Annual Meeting.
Current By-Laws state President appoints Chair of Nominating Committee and then says they appoint their own chair. It occurs in the following articles:
ARTICLE 9: Duties of Officers
Section 1 The President shall preside at all meetings of the Association and of the Executive Board; shall be a member ex-officio of all committees except the Nominating Committee; shall appoint the chairperson of all standing committees and the Nominating Committee;
ARTICLE 10: Standing and Special Committees
There shall be a Nominating Committee appointed by the Executive Board and composed of three (3) members (one (1) member from the Executive Board and two (2) members from the Association at large). This committee shall be created no later than two (2) months prior to the Annual Meeting. The committee shall elect its own chairperson.
The Board suggests change the following change in Article 9:
…shall appoint the chairperson of all standing committees except the Nominating Committee.
ARTICLE 8: Officers and Their Selection
Section 5: The Member At Large shall be a voting member of the Board to break any ties and shall be a member of the Judicial Committee.

ARTICLE 8: Officers and Their Selection
Section 1 The officers of the Association shall consist of a President, Vice President, Secretary, and Treasurer. These officers shall constitute the Executive Board.
Section 2 All officers shall be elected by secret ballot at the Annual Meeting and shall remain in office for a term of two (2) years with the option of reelection for a second two- (2-) year term. The secret ballot requirement may be replaced by a majority "show-of-hands" vote when the elections appear to be non-controversial.
Section 3 The Nominating Committee shall present its slate of candidates to be considered. Nominations may also be made from the floor with consent of the nominee.
Section 4 No officer shall serve more than two (2) terms in succession in the same position.
Section 5 The Member At Large shall be a voting member of the Board to break any ties and shall be a member of the Judicial Committee.
The Board suggests the following change to Article 8, Section 5:
Section 5 The Member At Large shall be a voting member of the Board to break any ties and shall be a member of the Judicial Committee. The Member At Large shall serve a one- (1-) year term and be elected at the General Annual Meeting.
It has come to the Board’s attention that the homeowner at 21012 Sierra Vista Drive, Parcel ID# 00129209, GIS 00129209, L45 M15-165 has not been charged annual dues in exchange for maintaining the second entrance Bahia Bay sign. The Executive Board suggests that this information be made part of the By-Laws.
As such, the Board suggests the following sentence is to be added to:
Article 4: Dues:
21012 Sierra Vista Drive, Parcel ID# 00129209, GIS 00129209, L45 M15-165 will not be subject to annual dues in exchange for light maintenance of the Bahia Bay second entrance sign provided this maintenance is performed to the satisfaction of the Executive board and is approved by the Executive board for each eligible year. Prior dues payments will not be refunded by the HOA and payment of dues by the lot owner for the current year constitutes a waiver of the maintenance responsibility by the lot owner.
